Human Rights Tribunal awards nearly $30,000 to a restaurant worker groped by a drunken boss

As an employee, you have a right to a workplace free from harassment and unwanted sexual advances. Unfortunately, as this case illustrates, women still face a disproportionally high risk of sexual harassment and assault, especially in the restaurant, bar and entertainment industries. The case below illustrates the seriousness of such conduct, especially when abuse by somebody in a position of authority is involved.

In this case the applicant, De Anna Granes, worked at the respondent's restaurant as a server prior to the incident. [1] One night, one of the co-owners became inebriated after consuming a number of drinks at the bar and started making inappropriate comments and sexual advances towards Ms. Granes. Ms. Granes asked him to stop. As the night progressed however, the advances culminated in inappropriate touching when the respondent put his arm around Ms. Granes, started groping her body, and suggested that they have sexual intercourse after she finished her shift. Ms. Granes reiterated that she wanted him to stop, but, despite this, the co-owner pushed her against the wall and tried to kiss her. Ms. Granes later suffered a panic attack and called the local police, but no criminal charges were filed. Ms. Granes filed a complaint with the Human Rights Tribunal, which awarded her $29,440 for injury to her dignity, self-respect and lost wages.
