There are a lot of common misconceptions with employment law, let us help you clarify some. For example:

WRONGFUL DISMISSAL

A wrongful dismissal does not mean that an employee was dismissed for trivial or illegitimate reasons. In fact, in Ontario, an employer can dismiss an employee for any number of reasons. Most of the time, this is known as a termination without cause.

When an employee is terminated without cause, they are entitled to reasonable notice of termination, also known as “pay in lieu of notice”, or more commonly referred to as a severance package.

If an employee does not receive adequate reasonable notice of termination, they are deemed to be wrongfully dismissed, which can give rise to a wrongful dismissal claim.

LAYOFFS

In Ontario, employers do not have an automatic right to lay off their employees. In most cases, when an employee is laid off, they may treat their employment as having been terminated and may pursue a wrongful dismissal claim.

REPRISALS

The Ontario Employment Standards Act and Occupational Health and Safety Act prescribe rights to protect employees in an employment relationship. At the same time, the employer is duty bound to respect those rights. A reprisal occurs when an employer punishes an employee for asserting – or even for simply inquiring – about those rights. When an employer violates anti-reprisal laws, they may be ordered to pay financial compensation to the victim.
