There are a lot of common misconceptions when it comes to employment law and your rights as an employee, let us clarify. For example:

WRONGFUL DISMISSAL

There is a misconception that an employee in Ontario can be dismissed without being provided notice of termination or termination pay. That is simply not the case! Employers can dismiss employees for a whole host of reasons (called termination without cause). However, employers are required to provide a reasonable termination notice period or “pay in lieu” of notice. Employees who have been denied this statutory right are entitled to file a suit for wrongful termination.

LAYOFFS

An employee cannot be “laid off” without cause unless it is stated within the employment contract. If you are laid off and your employment contract does not expressly provide for lay-offs, you are entitled to bring a suit for wrongful termination. In this case, the employee may treat their employment as being terminated and file for a wrongful dismissal claim.

REPRISALS

In Ontario, employees are protected by the Employment Standards Act (ESA) and Occupational Health and Safety Act (OHSA). Employers cannot punish an employee for simply inquiring about or invoking their rights in order to protect their health and safety. If an employer violates anti-reprisal laws, they may be ordered to pay financial compensation to the victim.
